The Texas Health and Human Services Commission has issued a new letter (PL 2021-16) informing nursing facilities about the resident refund review to be performed by the Trust Fund Monitoring Unit (TFMU) during routine monitoring visits. Facilities are required to resolve any accounts receivable credit balance within 30 days. The TFMU will review accounts identified as "Resident Responsibility" with a credit balance and determine if credits offset other balances owed by the resident. If the credit balances are not off-setting and were not refunded within the 30-day deadline, a deficiency may be cited. Facilities must correct the deficiency by providing documentation, refunding the credit, or escheating the credit balance to the state. The deficiency must be cleared within 60 days to avoid a vendor hold. This new review process aims to ensure timely resolution of resident credits and prevent negative impacts on Medicaid eligibility status.
