This letter outlines the regulations that nursing homes and other healthcare facilities must follow in order to protect the health, welfare, and rights of their residents. Facilities must develop and implement written policies and procedures to prohibit and prevent abuse, neglect, exploitation, and misappropriation of resident property. These policies must include screening potential employees for a history of abuse, neglect, exploitation, or misappropriation of resident property, as well as training new and existing staff on what constitutes abuse, neglect, exploitation, and misappropriation of resident property, how to recognize signs of abuse and neglect, how to report incidents of abuse and neglect, and how to respond to residents who may be at risk of abuse and neglect. Facilities must also post a conspicuous notice of employee rights and prohibit retaliation. Additionally, facilities must ensure that any crimes occurring in the facility are reported to law enforcement. Nursing homes and other healthcare facilities must take these actions in order to protect their residents and comply with the regulations.
