The California Department of Health has issued a new All Facilities Letter (AFL) regarding the certification of nurse assistants. Effective January 1, 2015, the department will no longer deny a certified nurse assistant (CNA) training and examination application, or revoke or suspend a CNA certificate, as a result of a conviction of specified violations. Instead, the department will evaluate CNA applicants with criminal convictions using its existing process, requesting evidence of good character and rehabilitation. The department will then grant or deny criminal record clearance based on criteria outlined in the Health and Safety Code section 1337.9(c).
