The California Department of Public Health has issued an All Facility Letter (AFL) regarding the informed consent process for skilled nursing facilities (SNF). The AFL explains that when a SNF issues a new order for psychotherapeutic drugs, physical restraints, or prolonged use of a device that may lead to the inability to regain use of a normal bodily function, the prescribing healthcare professional must obtain the patient's informed consent and place the documentation in the patient's medical record. SNFs can comply with this regulation by verifying that informed consent has been obtained from the patient for the proposed therapy and ensuring the documentation is in the patient's medical record, or by obtaining new informed consent and placing the documentation in the patient's medical record. The AFL includes updated "questions and answers" regarding informed consent, which are attached. Nursing homes and healthcare facilities should contact their local L&C District Office if they have any questions.
