The California Department of Health has issued a new All Facilities Letter providing direction for requesting program flexibility for nursing experience requirements for Home Health Agencies (HHAs). The letter acknowledges the difficulty some HHAs may have in recruiting nurses with the required one year of experience and offers two ways for agencies to request flexibility. They can either request a program flex for each individual registered nurse (RN) or licensed vocational nurse (LVN), or request a program flex of the one-year experience requirement that is HHA-specific, based on the new RN transition program. To request flexibility, facilities must submit a written request and supporting documentation demonstrating how they will meet the requirement through alternative means. Any approved program flexibility will be valid for one year, and HHAs must request approval annually to renew their flexibility.
