The Texas Health and Human Services issued a new Provider Letter (PL 2022-27) requiring nursing facilities (NFs) to update their Minimum Data Set (MDS) software for Section GG data collection. Effective November 1, 2022, NFs must complete Section GG and related fields before submitting an Omnibus Budget Reconciliation Act (OBRA) assessment. This data collection will help compare and evaluate costs under different payment models, such as the Resource Utilization Group (RUG) III and the Patient Driven Payment Model (PDPM). The new policy affects comprehensive OBRA and quarterly assessments, including admission, annual, and significant change in status assessments. NF providers must set the STATE_PDPM_OBRA_CD value to "1" in their MDS software and remove RUG-IV 48 Group version 1.03 as the setting for MDS Item Z0250 by November 1, 2022. The new policy aims to develop a new PDPM for Texas Medicaid Long-Term Care residents and replace the current RUG III Case-Mix system. Non-compliance may result in penalties or loss of Medicaid participation.
