Guidelines for the Patient Needs Waiver (PNW) and Workforce Shortage Waiver (WSW) of the 3.5 direct care service hour and/or the 2.4 hours per patient day requirements. Notifies SNFs of the waiver criteria and the application process for the waiver to address a shortage of available and appropriate health care professionals and direct caregivers.
A SNF seeking a WSW must submit a waiver application to the Department pursuant to the requirements in AFL 18-16. To renew a WSW, a SNF must reapply annually and submit an application.
The application filing period for PNW and WSW is open from January 1, 2023 through April 1, 2023. The online application portal can be found at riskandsafety.com. All applications and supporting documentation must be submitted no later than April 1, 2023. CDPH will not accept applications after 4/1/23.
While a SNF must meet the staffing criteria, having an approved waiver can mitigate a deficiency should it not attain either 3.5 o4 2.4.

The California Department of Health has issued an All Facilities Letter (AFL) announcing the opening of the application period for Skilled Nursing Facilities (SNFs) requesting a Patient Needs Waiver (PNW) and Workforce Shortage Waiver (WSW) for the fiscal year 2023-2024. The application filing period is open from January 1, 2023, through April 1, 2023. SNFs must submit their applications and supporting documentation through the online portal at Risk & Safety Solutions (RSS), which will open on January 1, 2023. The department will not accept applications or additional information submitted outside of this timeframe. After submitting an online waiver application, the provider's designated point of contact will receive an automated confirmation email containing a tracking number. The list of approved facilities will be posted on the CDPH Centralized Program Flex Unit (CPFU) webpage no later than July 30, 2023. For any questions regarding a submitted application, contact CDPH CPFU via email and include the tracking number in the email.
