Guidelines for the Patient Needs Waiver (PNW) and Workforce Shortage Waiver (WSW) of the 3.5 direct care service hour and/or the 2.4 hours per patient day requirements. Notifies SNFs of the waiver criteria and the application process for the waiver to address a shortage of available and appropriate health care professionals and direct caregivers.
A SNF seeking a WSW must submit a waiver application to the Department pursuant to the requirements in AFL 18-16. To renew a WSW, a SNF must reapply annually and submit an application.
The application filing period for PNW and WSW is open from January 1, 2023 through April 1, 2023. The online application portal can be found at riskandsafety.com. All applications and supporting documentation must be submitted no later than April 1, 2023. CDPH will not accept applications after 4/1/23.
While a SNF must meet the staffing criteria, having an approved waiver can mitigate a deficiency should it not attain either 3.5 o4 2.4.
