Clearpol's Summary of this Guidance
The California Department of Social Services (CDSS) has issued a new Provider Information Notice (PIN) regarding emergency intervention regulations for Adult Day Programs (ADPs), effective July 1, 2022. These regulations align with existing Adult Residential Facility Emergency Intervention regulations and are necessary to ensure providers are aware of additional requirements if an ADP uses or foresees the need for emergency interventions. The PIN clarifies appropriate use of restraint and seclusion in ADPs, specifies prohibited techniques, and outlines requirements for an initial assessment of each person for whom emergency interventions may potentially be employed. Healthcare facilities must comply with these new regulations to avoid potential consequences for non-compliance.
