The Centers for Medicare & Medicaid Services (CMS) issued a new Quality & Safety Memo (QSO-22-12-ALL) to remind State Survey Agency Directors of their obligations under the 1864 Agreement. This agreement requires states to survey healthcare providers and suppliers for compliance with Medicare and Medicaid health and safety requirements. States that fail to perform these functions may receive a reduced Survey and Certification budgetary allocation, jeopardizing the certification of providers and suppliers in that state. CMS may adjust the allocation for states that refuse to survey and certify compliance with all applicable regulations, reducing funds for the current fiscal year and each successive year until full oversight resumes. Accrediting organizations with deeming authority must continue surveying for compliance with all regulations. Providers and suppliers remain responsible for compliance with federal requirements.
