The California Department of Health has issued a new All Facilities Letter (AFL) informing skilled nursing facilities, nursing facilities, and swing bed hospitals that the Centers for Medicare and Medicaid Services (CMS) has ended the emergency blanket waiver for Title 42 CFR section 483.20, effective May 10, 2021. The waiver, which allowed providers flexibility in completing and transmitting Minimum Data Set (MDS) assessments during the COVID-19 pandemic, is no longer necessary as the majority of facilities have been completing and transmitting assessments timely. As a result, all facilities are now required to complete and transmit MDS assessments as required by Title 42 CFR section 483.20. The AFL advises facilities to distribute this information to their MDS coordinators, directors of nursing, and facility administrators.
