The Centers for Medicare & Medicaid Services (CMS) has updated its Long-Term Care Emergency Regulatory Waivers in response to COVID-19. CMS is ending emergency blanket waivers related to notification of resident room or roommate changes, transfer and discharge notification requirements, and certain care planning requirements for residents transferred or discharged for cohorting purposes. Additionally, the emergency blanket waiver of the timeframe requirements for completing and transmitting resident assessment information (Minimum Data Set) is also ending. CMS is providing clarification and recommendations for Nurse Aide Training and Competency Evaluation Programs. Nursing homes are now required to resume providing notice as required in the regulations, with 30 days advanced notice or as soon as practicable before the transfer or discharge of a resident, and before a room or roommate change. The updated waivers will be effective from May 10, 2021.
