Nursing homes and other healthcare facilities must allow residents to share a room with whomever they wish, as long as both residents consent to the arrangement. This could include opposite-sex and same-sex married couples or domestic partners, siblings, or friends. However, facilities are not allowed to displace a current roommate to accommodate the couple that wishes to room together, nor are they allowed to share a room if one of the residents has a different payment source or is not eligible to reside in a nursing home. When a resident is being moved, they must receive an explanation in writing of why the move is required and be provided the opportunity to see the new location, meet the new roommate, and ask questions about the move. Residents should also be given as much advance notice as possible when given a new roommate and be supported if their roommate passes away. Facilities must also provide social services for a resident who is grieving over the death of a roommate. This letter requires nursing homes and healthcare facilities to ensure that residents have the right to share a room with whomever they wish and that they are supported when a move or change of roommate is necessary.
