Clearpol's Summary of this Guidance
This letter explains the right of residents in nursing homes and other healthcare facilities to exercise self-determination with regards to activities, schedules, health care, and other aspects of life. Facilities must promote and facilitate resident self-determination by supporting and accommodating resident choices to the best of their ability. Facilities should also gather information to proactively assist residents with fulfilling their choices. Examples of how to meet this requirement include allowing residents to attend family gatherings, accommodating therapy schedules, and allowing residents to choose their own bathing times and methods. Facilities should also allow current residents who smoke to continue smoking in an area that is safe for both smokers and non-smokers. Nursing homes and healthcare facilities must take action to ensure that residents are given the opportunity to exercise self-determination, and that their preferences and choices are supported and accommodated.
