Nursing homes and other healthcare facilities must provide residents with access to their personal and medical records upon request, in a form and format that the resident can access and understand, within 24 hours (excluding weekends and holidays). They must also allow the resident to purchase a copy of their records with two working days advance notice, and charge a reasonable, cost-based fee for providing a copy, which includes only the cost of labor, supplies, and postage. The facility must ensure that the information is provided in a form that the resident can access and understand, including in an alternative format or language. In the event of noncompliance, the surveyor's investigation will generally show that the facility failed to support the resident's right to access their records, provide access within 24 hours, allow the resident to purchase a copy, charge a reasonable fee, or ensure the information is provided in a form that the resident can access and understand. This will require nursing homes and other healthcare facilities to take new actions to ensure that they are providing residents with access to their personal and medical records in a timely and cost-effective manner.
