Nursing homes and other healthcare facilities must not impose a charge against a resident's personal funds for any item or service covered under Medicare or Medicaid (except for applicable deductible and coinsurance amounts). Facilities may charge residents for requested services that are more expensive than or in excess of covered services. Facilities may also charge residents for items and services that are not required to achieve the goals stated in the resident's care plan, such as telephone, television/radio, personal computer or other electronic device for personal use, personal comfort items, personal clothing, and gifts purchased on behalf of the resident. Facilities must inform residents orally and in writing of any charges for items and services that are not covered under Medicare or Medicaid. Facilities must also not require a resident to request any item or service as a condition of admission or continued stay. Universal items, such as computers, telephones, television services, and other electronic devices, must not be charged to residents. Nursing homes and healthcare facilities must take these new regulations into account and be aware of the items and services that they can and cannot charge for.
