The California Department of Health has issued an All Facilities Letter (AFL) temporarily waiving specified skilled nursing facility (SNF) licensing and staffing requirements due to the COVID-19 state of emergency. The AFL extends parts of the waiver until March 1, 2021, and updates requirements for temporary COVID staffing waivers. SNFs can now provide care prior to obtaining approval and licensure for initial licensure, change of service, and increased bed capacity. The AFL also allows for flexibility in providing an activities program and space conversion to prevent the spread of COVID-19. SNFs must bring staffing levels into state ratio compliance within two weeks of the AFL issue date, and temporary staffing waivers will only be approved for a maximum of 90 days. The waiver is valid until March 1, 2021, and non-compliance may result in enforcement activities.
