The California Department of Public Health has issued a new All Facilities Letter (AFL) outlining procedural requirements for changes in Skilled Nursing Facilities (SNFs) ownership, transfers of facility operation, or changes in management companies. The AFL, effective January 1, 2020, mandates that prospective SNF licensees retain employees for a 60-day transition period, make written offers of employment, not discharge employees without cause, and not reduce wages or benefits. From July 1, 2020, SNFs must provide written notice of proposed changes to all facility residents and their representatives 90 days prior to finalization. The notice must include details about prospective licensees, management companies, ownership percentages, and expected dates of change. Non-compliance will result in a civil penalty of $100 per day for each day the notice is delayed.
