Notification of the chaptering of AB 1502 revising SNF and ICF requirements regarding licensure, changes of ownership (CHOW) and changes in management (CHOM) companies.
Effective 1/1/23, applicants for initial licensure must provide evidence that they have the financial capacity to operate the facility for 90 days and must notify CDPH 30 days prior to any change in the HSC ยง 1267.5(a) information submitted as part of an initial application or CHOW.
CHOW and CHOM applications on or after 7/1/23 follow the revised license application, review and approval process:
AB 1502 requires all approvals to take place before the CHOW or CHOM can occur.
A licensee planning to relinquish ownership, operation or management must report the intended transaction to CDPH at least 120 days prior to its anticipated occurrence.
Additional information including names and addresses of prospective owners, directors, board members and parent organizations and their directors, board members and managers along with evidence that they are reputable and responsible and have the financial capacity to operate the facility and any disciplinary information for the past five years is now also required.
