Clearpol's Opinion of this Guidance as of 05/11/2023
CDPH’s online COVID-19 SNF Survey is discontinued. The weekly CDPH COVID-19 surveillance/response-driven testing data reporting specified by AFL 20-60 is also no longer required and also not needed to be reported to NHSN unless requested.
QSO-23-13-ALL provides guidance. SNFs must continue to submit weekly COVID-19 data to DHHS via the CDC’s NHSN system until 12/31/24, in accordance with Title 42 CFR § 483.80(g). The reporting requirement at §483.80(g)(1)(viii) regarding COVID-19 vaccine status of residents and employees will continue indefinitely.
SNFs still must notify residents, resident representatives, and family members when there are COVID-19 positive residents or healthcare workers, per §483.80(g)(3) by 5 p.m. the next calendar day following the occurrence of either:
· A single confirmed infection of COVID-19, or
· 3 or more residents or employees with new-onset of respiratory symptoms occurring within 72 hours of each other.
Failure to report resident or employee incidences of communicable disease or infection, including confirmed COVID-19 cases (or Persons Under Investigation for COVID-19) as required may result in a federal and/or separate state enforcement action. CMS will impose a per day CMP of $1,000 for one day failure to report that week and an additional one-day CMP at an amount increased by $500 for each subsequent week.
Failure to comply may also be subject to a B citation.

Additionally, SNFs must continue to report COVID-19 vaccine status of residents and staff indefinitely. The weekly CDPH COVID-19 surveillance/response-driven testing data reporting specified in AFL 20-60 will also no longer be required effective May 12, 2023.
