Clearpol's Opinion of this Guidance as of 05/08/2023
Visitation is allowed for all residents at all times. The resident has the right to make choices about aspects of their life in the facility that are significant to the resident. Residents may deny or withdraw consent for a visit at any time. Therefore, if a visitor, resident, or their representative is aware of the risks associated with visitation, and the visit occurs in a manner that does not place other residents at risk (e.g., in the resident’s room), the resident must be allowed to receive visitors as they choose.
CMS still expects facilities to adhere to infection prevention and control recommendations in accordance with accepted national standards. This includes posting visual alerts at the entrance and in strategic places with instructions about current IPC recommendations.
It covers Outdoor and Indoor Visitation, including during an outbreak investigation. The facility’s policies regarding face coverings and masks should be based on recommendations from the CDC, state and local health departments, and individual facility circumstances.

Clearpol's AI Summary
The revised CMS memorandum QSO-20-39-NH, dated May 8, 2023, updates guidance on nursing home visitation during the COVID-19 pandemic. It emphasizes the importance of maintaining infection prevention practices and aligns with the ending of the Public Health Emergency (PHE). Visitation is now allowed for all residents at all times, and facilities must adhere to the core principles of COVID-19 Infection Prevention and Control (IPC). The memo also provides guidance on outdoor and indoor visitation, face coverings, visitor testing and vaccination, and communal activities. Nursing homes must facilitate in-person visitation in accordance with CMS regulations and are subject to citation and enforcement actions for non-compliance. The memo encourages facilities to offer testing to visitors and strongly encourages vaccination for all visitors.
