The California Department of Health has issued a new All Facilities Letter, extending a temporary waiver of specified regulatory requirements for skilled nursing facilities (SNFs) until June 1, 2021, due to the ongoing COVID-19 state of emergency. The waiver allows SNFs to begin providing care prior to obtaining approval and licensure for initial licensure, change of service, or increased bed capacity. It also grants flexibility in providing activities programs and temporarily suspends enforcement of certain space conversion requirements. However, this revision rescinds all temporary COVID-19 staffing waivers, and SNFs must maintain required staffing levels at all times starting March 1, 2021. The waiver is subject to certain conditions, including following infection control guidelines and reporting any substantial staffing or supply shortages.
