Clearpol's Opinion of this Guidance as of 04/14/2023
CCLD CPMB has updated LIC 9182, Criminal Background Clearance Transfer Request Form and LIC 9188 Criminal Record Exemption Transfer Request Form and the Privacy Notice on each form, after the implementation of SB 1093 and AB 1720 effective 1/1/23.
This updates guidance on the process for transferring a criminal record clearance or exemption from one licensed facility to another. Individuals seeking to transfer their clearance or exemption are encouraged to use the new versions when submitting a transfer request outside of Guardian.
SB 1093 no longer requires an individual or licensee to verify their identity with their request. A licensee is responsible for verifying the individuals identity, if the licensee asks CPMB to verify whether an individual has a clearance or exemption that can be transferred.
AB 1720 no longer requires a LIC 508 Criminal Record Statement to be submitted with the request.

Clearpol's AI Summary
PIN 23-08-CCLD announces updates to the Criminal Background Clearance Transfer Request Form (LIC 9182) and the Criminal Record Exemption Transfer Request Form (LIC 9188) following the implementation of Senate Bill 1093 and Assembly Bill 1720. These updates impact the process for transferring a criminal record clearance or exemption from one Department-licensed facility to another. Notably, individuals or licensees requesting to transfer their clearance or exemption are no longer required to include verification of their identity with the request, and the transfer forms no longer require a Criminal Record Statement form (LIC 508) to be submitted. A new section has been added to the forms for individuals transferring their clearance or exemption to a children's residential program facility, requiring them to report if they have lived in another state within the last 5 years for conducting an out-of-state child abuse and neglect check. Nursing homes and healthcare facilities should use the new version of the applicable form when submitting a transfer request outside of the Department's online portal, Guardian.
