The California Department of Health has issued a new All Facilities Letter, effective January 1, 2018, prohibiting long-term care (LTC) facility staff from discriminating against or denying care to seniors based on their actual or perceived sexual orientation, gender, gender identity, gender expression, or HIV status. This includes denying admission, transfer, or eviction; denying room-sharing requests; assigning rooms contrary to a transgender resident's gender identity; and harassing residents using restrooms of their gender identity. Facilities must also use a resident's preferred name and pronouns, allow residents to wear clothing of their choice, and not restrict residents' associations or medical care. LTC facilities are required to post a nondiscrimination notice and provide employees access to an online learning tool on respecting LGBT older adults.
