The California Department of Health has issued a new All Facilities Letter (AFL) updating reporting requirements for unauthorized access or disclosure of patient medical information. This letter affects various healthcare facilities, including nursing homes and hospitals. As of January 1, 2015, healthcare providers must report a breach of medical information to the California Department of Public Health (CDPH) and the affected patient within 15 business days, rather than the previous 5 business days. Facilities must provide written notification to affected patients or their representatives, with the option to use alternative means or locations specified by the patient. Email notifications are only allowed if the patient has previously agreed to electronic notification in writing. All other medical information breach reporting requirements remain in effect, and facilities are responsible for following all applicable laws and regulations.
