The California Department of Health has issued a new All Facilities Letter outlining revised mandated reporting requirements for nursing homes and other healthcare facilities under the Elder Abuse and Dependent Adult Civil Protection Act (EADACPA). Effective January 1, 2013, facilities must report suspected abuse to the local Long-Term Care Ombudsman, local law enforcement, and the Licensing and Certification Program. The time frame for reporting serious bodily injury has also changed. If suspected abuse results in serious bodily injury, facilities must report the incident immediately and no later than two hours by telephone to local law enforcement, and send a written report within two hours to the local law enforcement agency, the Licensing and Certification Program, and the Ombudsman. If the suspected abuse does not result in serious bodily injury, the mandated reporter must report the incident by telephone within 24 hours to the local law enforcement agency and provide a written report to the local Ombudsman, the Licensing and Certification Program, and the local law enforcement agency within 24 hours. Facilities are encouraged to review their policies and procedures to ensure compliance with the new reporting requirements and time frames.
