The California Department of Health has issued a new All Facilities Letter outlining requirements for skilled nursing facilities (SNFs) and nursing facilities (NFs) in the event of closures. The interim final rule requires administrators to notify various parties, including the California Department of Public Health, the State Long-Term Care Ombudsman, and residents, of the closure and relocation plans 60 days prior to the closure date. The facility must also ensure no new residents are admitted after the closure notification date and provide for the transfer and adequate relocation of current residents. Failure to comply with these requirements may subject administrators to personal liability for civil monetary penalties. The final rule is expected to be issued by February 2014.
