The California Department of Health has issued a new All Facilities Letter, effective August 1, 2010, announcing a policy change for the imposition of Denial of Payment for New Admissions (DPNA) in nursing homes. The Centers for Medicare and Medicaid Services (CMS) has authorized states to issue a notice for statutory DPNA in their initial notice for enforcement actions when substantial noncompliance is found. The effective date for the statutory DPNA will be three months from the original date of the survey. If nursing homes disagree with the determination of noncompliance, they can request a hearing before an administrative law judge within 60 days of receiving the official notice letter. This policy change aims to ensure consistent enforcement of DPNA requirements and will impact nursing homes and other healthcare facilities in California.
