The Health and Human Services Commission (HHSC) has announced the end of temporary waivers of certain long-term care regulatory requirements related to COVID-19. Effective February 13, 2023, nursing facilities must adhere to rules and requirements regarding residents' right to receive visitors. Additionally, certain waivers concerning certified nurse aides (CNAs) will end on April 5, 2023, or the end of the public health emergency, whichever comes first. From that date, nursing facilities must ensure that nurse aides are not employed for longer than four months unless they meet CNA certification requirements. Other waivers related to clinical and skills training, application submission, and processing timeframes for CNAs and medication aides will end on May 1, 2023. Nursing homes and healthcare facilities must comply with these updated rules and regulations.
