The California Department of Social Services (CDSS) has issued a Provider Information Notice (PIN) requiring nursing homes and other adult and senior care facilities to notify families of all persons in care when someone in the facility tests positive for COVID-19. This notice should not disclose any personally identifiable information or protected health information about the person who tested positive. Additionally, facilities must notify the authorized representative of the person who tested positive, as required by applicable regulations. Effective April 27, 2020, the PIN has been updated to advise that notification should also include all persons in care and healthcare professionals/individuals providing healthcare-related support that enter the facility to provide services. The CDSS aims to ensure proactive communication between licensees, persons in care, their families, and facility staff. Failure to comply with these requirements may result in penalties or other consequences for non-compliance.
