The California Department of Health has issued an All Facilities Letter (AFL) announcing the expiration of temporary waivers related to the COVID-19 pandemic on February 28, 2023. Healthcare facilities, including nursing homes, must comply with statutory and regulatory requirements by March 1, 2023. The waivers expiring include those related to hospital requirements, professional certification requirements for Certified Nurse Assistants and Home Health Aides, and specified skilled nursing facility requirements. Facilities needing continued flexibility beyond the end of the declared COVID-19 emergency may submit a program flexibility request. However, the department will not consider any flexibility requests for staffing ratios. Facilities should submit their requests as soon as possible to allow adequate evaluation time. Any questions regarding program flexibility should be directed to the Centralized Program Flex Unit.
