A new provider letter (PL 2022-29) has been issued for Assisted Living Facilities (ALFs) and Nursing Facilities (NFs) in Texas, outlining new rules effective from December 6, 2022. These rules implement H.B. 1423, S.B. 199, S.B. 271, and S.B. 383 from the 87th Legislature, Regular Session, 2021. Key changes include an increase in the frequency of unannounced NF inspections, monthly inspections of automated external defibrillators in NFs, a requirement for ALFs to obtain out-of-state criminal conviction disclosures from employee applicants, and mandatory memory care disclosure statements for ALFs and NFs providing memory care services. Additionally, some agency-initiated changes have been made to the ALF and NF rules. New and revised forms have been created to implement these changes, and facilities are advised to contact the Policy and Rules Unit for further information.
